BSP Bot terms of service

These terms apply to businesses that use BSP Bot. By using it, your business agrees to them. Where you have signed a separate agreement with us, that agreement prevails where the two differ.

The service

BSP Bot is a WhatsApp assistant that answers your customers on your behalf, using the instructions and documents you give it, with a dashboard to set it up and follow its conversations. We set up each workspace together with you.

Your account

Keep the sign-in details for your workspace secure, and tell us at once about any use you did not allow. You are responsible for what the people you give access to do in it.

Your obligations

  • Follow the WhatsApp Business Terms of Service and Meta's WhatsApp Business and Commerce policies.
  • Message only people who contacted you or agreed to hear from you, and honour every opt-out. BSP Bot stops proactive messages when a customer replies STOP; do not work around it.
  • Tell your customers that an automated assistant answers for you, and use it only for your business, never for unlawful, deceptive or harmful content.
  • Make sure you have the right to use the documents, accounts and data you connect.

What the assistant says

Replies are written by AI. The assistant is told to answer only from your instructions and documents, but it can still be wrong. Keep your documents current, check what it says about prices, bookings and policies, and require approval for actions a person should confirm. You remain responsible for what is said to your customers in your name.

Fees

Fees are as agreed with you in writing, or as shown on our pricing page. Subscriptions are paid in advance through our payment provider, Mollie. Meta charges its WhatsApp fees to your WhatsApp Business account directly; they are not part of our fees.

Your data

Your content remains yours. We process your customers' personal data only on your instructions, as your processor, as described in our privacy policy. Our data processing agreement forms part of these terms and is available on request.

Availability and changes

We work to keep BSP Bot available, but cannot promise it will never be interrupted. We may change or improve features, and we will tell you in advance about any change that takes away something you pay for.

Ending the service

You can cancel at any time, with effect at the end of the period you have paid for. We may suspend or end the service if you breach these terms, put the service or other people at risk, or do not pay. When an account ends, its data is deleted as the privacy policy describes.

Liability

Our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, lost profit or lost data. These limits do not apply where the law does not allow them, such as in cases of intent or gross negligence.

Law and disputes

Dutch law governs these terms. Any dispute goes to the competent court of Midden-Nederland, in the Netherlands.
